1.1 This website, smart-con.net (the "Website"), is owned and operated by Peak CS Limited, a company incorporated under the laws of the Republic of Malta with registration number C 91687 and registered office at 115B, Suite 3, Old Mint Street, Valletta VLT 1515, Malta (the "Company", "we", "us", or "our").
1.2 These Terms and Conditions (the "Terms") govern your access to and use of the Website and set out the relationship between the Company and anyone who visits or uses the Website ("you", "your", the "User").

If you do not agree with any part of these Terms, please do not use the Website.
1.4 These Terms are provided and concluded in English. Any translation is offered for convenience only. In the event of any conflict, the English version prevails.

6. Recruitment and Job Applications
6.1 Where the Website makes a recruitment Form available:
- Each Applicant must complete the Form accurately and submit the information requested.
- By submitting the Form, you accept these Terms, and you confirm that you have the legal capacity to apply and that doing so does not breach any other agreement to which you are a party.
- You authorise the Company to use the information you provide in order to assess your skills, qualifications, and suitability for a role, to carry out background and reference checks where lawful and applicable, to communicate with you about the recruitment process, to keep records of its hiring processes and to comply with any legal or regulatory obligations.
- Submitting an application does not create any offer of, or entitlement to, employment. The Company is under no obligation to progress or respond to any application, and may decide, at its sole discretion and without liability, that an application does not meet its recruitment requirements.
- Staffing and recruiting agencies and individuals being represented by an agency are not allowed to use this site to submit profiles, applications or CVs, or to forward CVs directly to employees or any other company location, and any such submissions will be considered unsolicited.
6.2 The Company makes no guarantees that by submitting the Form on the Website, an Applicant will be guaranteed employment with our company.

7. Your Representations and Warranties
7.1 By using the Website, you represent and warrant that:
- you are at least 18 years of age and have the legal capacity to agree to these Terms without the consent of any other person;
- you reside in and access the Website from a jurisdiction in which such access and use is lawful;
- all information you submit through the Website is true, accurate, current, and complete, and you are authorised to provide it;
- you will not complete any Form using another person's information without their authority;
- you will conduct yourself professionally and refrain from abusive, threatening, or offensive language in any communication with the Company, whether by Form, email, telephone, or otherwise; and
- you will comply with all applicable laws in your use of the Website.

16.1 You may not assign or transfer any of your rights or obligations under these Terms. The Company may assign or transfer its rights and obligations under these Terms to any successor or affiliate without your consent.

18. Governing Law and Jurisdiction
18.1 These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of the Republic of Malta.
18.2 The parties agree to submit to the exclusive jurisdiction of the courts of Malta to settle any such dispute or claim.
